Five Answers to One Word
Tutor's report — Lesson 1 closed: the Donoghue revision debates of 12–13 September 2026.

Purpose: close Lesson 1 (the ratio decidendi) after two postponements of Lesson 2.

What held
Buckmaster's ground — authority and contract, against Atkin's "general conception" — stated correctly on the Sunday after being floodgates-for-both on the Saturday. The neighbour passage near-verbatim from memory. The manufacturer's rule whole (from notes, declared) and then held at Atkin's own rung under a Stone-style push. Goodhart/Stone/Hart in order, unprompted; the August Hart-for-Goodhart error conceded in terms. "I don't know," then reasoning, on the clear-glass hypothetical — the first clean instance on the record. The underwear case reasoned correctly unprompted (inspectable; defect invisible; so no reasonable possibility of examination). "Trick" withdrawn under one question. A position at the end: bindingness as a function of hierarchy.
Where it broke
On bound. Asked what the narrow rule bound the next court to, given that later courts were free to take the obiter instead, he gave five answers in sequence — it bound; to the six conditions; to moral precepts; in theory; yes a myth, but not entirely — and withdrew none. He split theory from reality rather than resolve it. The resolution he needed he had named himself at the second turn ("open texture") and never applied. This is a Level 3 question and he is at Level 1; breaking there is correct. The Level 1 questions he passed.
The word: abused — assumes the answer to the question. Reading not done: Reid beyond the fairy tale ("Reid confirms precedent is a myth" is the reverse of the lecture); Hart ch 7 named, not used. He admitted the Reid gap honestly rather than copy-pasting.
Exit tests (occasion 1 of the 2 required)

Wounds
- Fog is not depth — recurred on 12 Sept ("implicit", "the citizen", "the understanding of that speech"); on 13 Sept replaced by "I don't know" plus reasoning twice. Movement, real.
- Cannot inhabit an argument he disbelieves — not tested; no flip in an unmarked session.
- Cites from memory — "Reid confirms precedent is a myth"; "avenue of approach" attributed to Macmillan, unverified. Names now right (Atkin, Tomlin, Goodhart). The quotations are the residue.
Tutor's failures, on the record
No transcript of the 23 August hour was kept; the "moral availability" debt was cancelled because the tutor could not reproduce the context. Transcripts are now written as the hour proceeds. On 13 Sept the tutor named the majority Lords in a question when the student should have; taken in one clause.
